Objectives of the course

Introducing students with basic concepts of civil procedural law, especially the organization of courts in Bosnia and Herzegovina, and the role of other judicial bodies in civil, non-contentious and enforcement proceedings. Observe the distinction between litigation, non-contentious and enforcement proceedings from the point of view of the application of substantive law in these proceedings and to understand the function of adjudication and the function of execution of court decisions.

Students’ ability to understand and solve specific civil legal disputes through the function of adjudicating and enforcing court decisions.

Content of the subject

Litigation procedure, concept and goal; sources of civil procedural law; the principles of civil procedure, the relationship between civil and other procedures; organization of judiciary; nature of litigation; process assumptions; actual and local jurisdiction of the courts; litigants; proxies and representatives; civil proceedings; concept and division of lawsuits; defense of the defendant; the plurality of subjects; the plurality of lawsuits; participation of third parties in litigation; alteration of the lawsuit; against the lawsuit; main discussion; proving; interruption of proceedings; court settlement; types of decisions; regular remedies; extraordinary remedies; principles of non-contentious proceedings; special out-of-court procedures; principles of enforcement procedure; types of execution; suspension and postponement of execution; legal remedies in the enforcement proceedings; securing procedure.

Teaching methods and material mastering

Lectures, exercises, consultations, written examinations (colloquiums) individual student work (seminar and homework, papers, etc.), as well as group participation of students in the study of certain thematic units.
